Washington business and real estate lawyer Jeff Helsdon discusses adverse possession.
There are times when property begins to be yours even though you didn't buy it or obtain it in the first place. An example of this is a fence on a property line. If the fence is being maintained and repaired by yourself and by virtue has become your property, you may have an action for adverse possession. This idea is to help prove that some piece of property has become yours automatically over the years. There are a few things you need to do in order to prove ownership.
You must show you have actual possession of the property and that the property is hostile to the original owner. You must also show that the property is visible by a third party and your possession must continue for 10 years. You must meet all these elements to show adverse possession.
